Who Can Benefit from It?
The tax credit is specifically aimed at independent film producers. To qualify, your film must meet the following key criteria:
It must be intended for theatrical release, meaning it’s produced to be shown in cinemas.
It should pass the British Film Institute’s Cultural Test, which ensures that the film contributes to British culture in some way, whether through its setting, subject matter, or the people involved in its creation.
The film will also need to have either a UK writer or director or be certified as an official UK co-production.
The production must be independent, meaning it isn’t controlled by a major studio or production company.
If your production ticks these boxes, you could be eligible to claim up to 53% of your production costs as a rebate.
How Does It Work?
Here’s a simple overview of how the tax credit works:
You apply for your BFI Certificate
Production Costs Are Incurred: You spend money making your film, from paying your cast and crew to renting equipment and locations. The costs you can claim the relief on are capped at 80% of this expenditure (up to a maximum of £15m). The expenses must have been incurred after 01/04/2024.
You Apply for the Tax Credit: After incurring costs, you submit a claim for the Independent Film Tax Credit on your company’s tax return.
Receive Your Rebate: If your application is approved, you can get money back on some of your production expenses. The rebate is based on 53% of your eligible costs. The most you can get back is £6.36 million, but that’s only if your core production costs are as high as £15 million.
However, after paying some corporation tax on the rebate, you’ll receive £4.77 million in cash.
It’s essential to keep good records of all your production expenses and work with an accountant to ensure that your claim is accurate and you get the maximum benefit possible.
